Mediation is one of the two common methods of Alternative Dispute Resolution also know as ADR. Arbitration is the other. As a mediator, he is an impartial third party who helps the parties to
stay focused on the issues at hand rather than their own positions. As the mediator, he sets forth the rules and steps to be followed. Then,
he begins the fact finding process. Once an agreement is reached, he explains the terms to both parties for a full understanding.
Studies show that agreements reached during
the mediation process are more likely to be complied with than decisions imposed by arbitrators or judges. This possibly can be attributed to both parties being involved in determining the resolution instead of an arbitrator or
